These Terms & Conditions of Sale (“Terms of Sale”) govern all purchases of products from That’s Besties® (“That’s Besties,” “we,” “us,” or “our”).

By placing an order, you agree to these Terms of Sale.

These Terms apply to both individual (D2C) and commercial (B2B) purchasers unless otherwise stated in a separate written agreement.

All orders are subject to acceptance by That’s Besties®.

We reserve the right to:

• Refuse or cancel any order
• Limit quantities
• Correct pricing errors
• Cancel suspected fraudulent orders
  

Orders are not binding until confirmed.

• Prices are listed in U.S. dollars.
  
• Prices may change without notice prior to order confirmation.
  
• We reserve the right to correct typographical or pricing errors.
  
• Taxes, shipping, and handling are added at checkout unless otherwise stated.
  

If a pricing error occurs, we may cancel the order and issue a refund.

We accept major credit cards and other payment methods displayed at checkout.

Payment is due at time of purchase unless otherwise agreed in writing.

We reserve the right to:

• Cancel orders due to failed payments
  
• Charge reasonable collection costs for unpaid invoices (commercial accounts)

Shipping timelines provided are estimates and not guaranteed.

Risk of loss and title transfer to you upon delivery to the carrier (FOB Shipping Point), unless otherwise required by law.

That’s Besties® is not responsible for:

• Carrier delays
  
• Lost or stolen packages after confirmed delivery
  
• Incorrect shipping information provided by customer
  

Commercial freight shipments may require inspection at time of delivery.

You must inspect products immediately upon receipt.

Any damage, shortage, or defect must be reported within five (5) business days of delivery.

For freight shipments:

• Damage must be noted on delivery receipt before signing.
  

Failure to notify within five (5) business days constitutes acceptance of goods.

Commercial freight shipments may require inspection at time of delivery.

Returns are governed by our Refund Policy.

Due to hygiene and safety standards:

• Period products and wipes are final sale unless defective.
  
• Dispensers may be eligible for return subject to restocking fees and inspection.
  

Shipping costs are non-refundable unless required by law.

Dispensers

Dispensers include a limited one (1) year warranty from date of delivery under normal use.

Warranty is limited to repair or replacement of defective parts.

Warranty does not cover:

• Normal wear and tear
  
• Cosmetic damage
  
• Improper installation
  
• Use of non–That’s Besties® refill products
  
• Misuse, vandalism, or abuse
  

Consumables (Wipes, Pads, Tampons)

Consumable products are sold “as is” except for manufacturing defects.

To the fullest extent permitted by law, all other warranties are disclaimed.

Except as expressly stated, products are provided “as is” and “as available.”

We disclaim all implied warranties, including:

• Merchantability
  
• Fitness for a particular purpose
  
• Non-infringement
  

Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

To the fullest extent permitted by law:

That’s Besties® shall not be liable for:

• Indirect damages
  
• Consequential damages
  
• Incidental damages
  
• Lost profits
  
• Business interruption
  

Total liability shall not exceed the amount paid for the product giving rise to the claim.

For B2B or bulk orders:

• Buyer assumes responsibility for proper installation and maintenance.
  
• Buyer agrees not to modify products without written authorization.
  
• Unauthorized resale or redistribution may void warranty.
  

Additional commercial terms may apply under separate agreements.

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including but not limited to:

• Natural disasters
  
• Supply chain disruptions
  
• Labor shortages
  
• Government actions
  
• Carrier delays
  

You agree to indemnify and hold harmless That’s Besties® from any claims arising out of:

• Misuse of products
  
• Failure to follow instructions
  
• Unauthorized modification
  
• Violation of law

You agree to contact us to resolve disputes before initiating a chargeback.

Improper chargebacks may result in:

• Account suspension
  
• Collection efforts

These Terms of Sale shall be governed by the laws of the State of Georgia.

Any disputes shall be resolved in Georgia courts unless arbitration applies under separate agreement.

If any provision is found unenforceable, the remaining provisions remain in effect.

These Terms of Sale constitute the entire agreement regarding product purchases unless superseded by a written agreement.
